NDRC Solicits Opinions on Regulation on Anti-Price Monopoly (Exposure Draft) from the Public

The National Development and Reform Commission (NDRC) announced on August 12 to solicit opinions on Regulation on Anti-Price Monopoly (Exposure Draft) from the public, which covers the price monopoly acts at home and abroad.
NDRC pointed out in the announcement that for the purpose of preventing and curbing price monopoly acts, protecting fair competition and maintaining the consumers' interests and social public interests, in accordance with the Anti-monopoly Law of the People's Republic of China, NDRC has drawn up the Regulation on Anti-Price Monopoly (Exposure Draft). To fully listen to the opinions from every aspect, online opinions are hereby solicited for the Exposure Draft, and various circles of society are welcomed to propose opinions and suggestions of revision. The deadline for the feedback of relevant opinions and suggestions shall be on September 6, 2009.
The Exposure Draft issued by NDRC online provides, "the Regulation herein shall be subject to the price monopoly acts in the economic activities in the People's Republic of China as well as those outside the People's Republic of China, which have impacts of exclusion and restriction on domestic market competition."
According to the Exposure Draft, price monopoly includes price monopoly agreement and the price monopoly abusing market dominant position. Regulation on Anti-Price Monopoly (Exposure Draft) shall be also subject to the acts that administrative organs and organizations with the function of managing public affairs authorized by laws and regulations abuse the administrative authority to exclude and restrict competition in price.
The Regulation on Anti-Price Monopoly (Exposure Draft) totals 29 items and about 4000 words.
